WILKINSON, Circuit Judge: The National Labor Relations Board (""Board"") seeks enforcement of its bargaining order against Lundy Packing Company, Inc. (""Lundy""). The principal basis for Lundy's refusal to bargain is its contention that the Board improperly excluded certain quality control employees from a production and maintenance bargaining unit. We agree. The Board's bargaining unit determination both contravened its own announced standards and accorded controlling weight to the extent of union organization at Lundy, thereby violating § 9(c)(5) of the National Labor Relations Act. Accordingly, we deny the Board's petition for enforcement.
